"Social Security Disability and Child Support"
Does anyone know how being declared disabled and then on Social Security Disability affects one's child support obligation?

That depends on the states and courts involved. I think you will have to consult a lawyer as to whether you will relived of child support.

on the other hand, you can request a social security estimate of benefits or get one when you submit an application for benefits. You can even request on online at the Social Security page.

Your disability benefits may be such that continued child support is a non-issue.

Get the numbers from SS and have a short consultation with a lawyer so you make informed decisions.

Another thing to remember is that the child or children are also entitled to receive benefits from SSI. I know that my SO Mark's children were receiving benefits equal to 1/3 of his total monthly amount prior to his death. It wasn't a huge amount, but every bit helped, especially since he felt so terrible about not being able to do his share financially.

I'm not sure which side of the coin you are on in that issue. My friend is on SSI from MS, she divorced a year later and her ex still pays a whopping amount of child support to her. Luckily she also gets permanent alimony!!! Hope you live in Ohio.Her daughter gets a monthly check from SSI also.

I am the one paying child support. Actually, the only reason I am working is to pay it. I have cut back to a part time job (under 20 hours a week)due to the migraines but was concerned since they are getting to be a problem again.

I don't want my children to go without but I also know I cannot continue to work if these migraines are going to be frequent again. I just wanted to know what happens has a judgement to pay child support and then cannot do it.

Hey Leslie,

Child support is such a mine field. I strongly suggest that you (if you can) discuss it with your ex-husband.

For the legal aspects, you need a sit down with a lawyer. To put you mind at ease. You just can't make decisions unless you know your options.

My ex and I used mediation to determine child support and other matters. It worked for us and saved us both money. When it came time for her to pay child support, she refused. Something about it is just wrong for a mother to pay support (?) At the time I was not disabled and did not fight it. Court battles are so stressfull on all parties.

But find out what your legal and familial options are. You can not make a choice of action until you know your choices.

Thanks for your thoughtful response to my post, Richard. I have a court order to pay child support already. It amounts to 25% of my gross pay but was based on my pay from 1999 when I worked part time.

This amount makes up 50% of my part time take home pay here in Florida. (I'm from NY). I made the decision to work part time as I was overstressed by full time work and I am legally obligated to pay support.

My ex-husband is not sympathetic to my condition. I know this as when I was married to him, my migraines were not regarded as anything more than my own selfishness.

Your child support is based on the current income that you are making. In SD you can have free mediation. It also takes into account other assests...such as houses, ins..who pays for the child's health ins, etc. Many many things effect/affect the ability. In SD there is a minimum of I think 100 or 150 dollars per month that must be paid. If you are disabled that would be a different story. You might have to contact the state in which the money is ordered owed. If you kid lives in NY, and you live in FL it is likely NY.

If you indeed get on SSI your child will be entitled to payment by the government. It will not reduce your benefit the way The way it has been explained to me. I don't know if you would have to pay again through you personal benefits or if the court would say what the child gets is adequate.

ALso child support pymts can be reduced also for helath expenses etc. The judge told me htat hecould not force my former husband to work but he could not get by in this state with out the 150.00 minimum.

THere are alot of fine points here. Go through the child support enforcement services offered in your state. In SD they are free. In your case you don't always have to apppear for the mediation services. It's all in black and white on paper. Good luck,

When I was applying for SS Disability, I was told that my son would get his own portion of back pay up until the time he turned 18. So, it does look like your sons would still be eligible for their fair share which would probably be close to what you are sending now.

I did not realize that Social Security changed from state to state. I was under the impression that it was a national program and would be consistent everywhere. You might want to check that out first as the information you have received here might just save you that attorney visit.

I do think that you will need the attorney once you decide to file. Remember, Leslie, "Go for it!" Hugs! Wendy
