"Social Security Disability Hearing"
Well, some of you have asked me in the past to let you know how my upcoming hearing for disability benefits turned out. I went to the hearing this morning. The administrative law judge asked me a lot of questions about my migraines and about how they affect the family and kids. I have recently begun being treated for depression but I was truthful with the judge in saying that my depression is not severe enough to prevent me from work, just the migraines. I was so scared going in front of him. So many people dont believe that a "little headache" can cause so much disruption in your life. But at the end of the hearing, about 25 minutes, he said to my attorney "Counselor, I find that your client is very credible in her testimony and that she is disabled and has been disabled since the time of filing." And that was it, It was over!! Solely based on my migraines. I ams o glad that it is finally over. Now I just have to wait for them to calculate how much and I will get back benefits to when I first applied. I would be more than happy to answer any more detailed questions anyone may have for me. I would like to be able to help someone else. Thanks for all the support from everyone, Debra

I am so happy for you. I have seriously been thinking about filing for disability myself. I have been afraid to because I am terrified of being hurt and shamed. As you know, I am in a fragile state right now and have been for some time. I would like to shake the hand of the wonderful judge who obviously understood the horrible pain you go through!

GREAT NEWS!!

I am so glad to hear you were successful. I am now waiting for the first ruling on my own application. The Social Security office said it would take 3 to 6 months, but everyone has been telling me that it would automatically be rejected the first time (for that they need 6 months?), and that I would need to appeal.

The doctor treating my depression (which, like yours, is NOT the reason I can't work) said I have a strong case for disability -- but he also gave me the name of an "advocate" to help with an appeal, if need be.

How many go-rounds (and how much time) did it take for you to win? And, if you don't mind telling us, how much do you have to share with your lawyer?

Well, I originally filed on Sept 20, 1999, so almost a year and will be by the time benefits start coming. I was denied at both the original filing and at the reconsideration levels. I was told that those denials are automatic because migraine is not on the automatic approval list of impairments. I have no idea why it takes so long for a decision to be made. My lawyer said that what she needed to win my case was my doctor to say that I can't work during a migraine and that they happen often enough to prevent me from doing adequate work. Well, my neurologist wrote me a letter, before which I didn't tell her what my lawyer needed it to say. It was only about three lines but it said that my migraines were "quite disabling" and during them I would not be able to do any work. Also that I had to stay in bed nearly all day about five days per week when I had a migraine. So this was exactly what I needed to take to the ALJ. My lawyer asked me everything about my migaines and how it affects my life, my family, the kids, etc. Also the judge wanted to know who helps take care of the kids when I have a migaine, who does he housekeeping, the grocery shopping, stuff like that. They look at it as if if you can do the housecleaning, shopping, and take care of kids, those kinds of everyday things, then you aren't disabled. I hope this helps you. WOW !!! You and I have alot in common. my nick name on the computer is also Ladybug, and I too just went for my hearing before the judge for my disability. But unlike you, I am still waiting for the verdict. It has been over 2 weeks now, and no word yet. Now I am kind of worried. Since the judge told you at the hearing that you were disabled, I am thinking that maybe my verdict will not be so good. I am so happy that you got your verdict so fast, I know how hard it is to prove you are disabled due to migraines.
The judge in my case kept calling them "headaches", and I wanted to tell him that migraines are not headaches. But my attorney told me to just answer his questions, and say nothing more. I am praying I get approved, but now I have my doubts. I just get so tired of this!!!!!!

Don't get too worried before you hear something, I was told that my judge hardly ever issues a decision right away, that it usually takes 30 to 60 days for the ruling. I guess my judge looked favorably upon me. I will pray that you get your answer right away and it is positive for you. Let me know if I can help you in any way. Debra
